Welcome to Maya & Zoe Atelier! The terms “we”, “us” and “our” refer to Maya & Zoe Atelier. We operate this store and website, including all related information, content, features, tools, products and services (the “Services”). Our store is powered by Shopify. These Terms of Service (“Terms”) govern your use of the Services. By visiting or using the Services, you agree to these Terms and to our Privacy Policy.

1. Access and Account

You represent that you are at least the age of majority in your country of residence. To use the Services you may need to provide information (e.g., email, billing, payment, shipping). You warrant such information is accurate and that you have the right to provide it. You’re responsible for keeping your credentials secure and for all activity under your account. You may not transfer or sell your account.

2. Our Products

We aim to display our products accurately, but colours/appearance may vary by device and settings. We do not warrant that products will meet your expectations. Descriptions and availability may change at any time; we may limit quantities per person, region, or order.

3. Orders

Your order is an offer to purchase. We may accept or decline at our discretion; payment must be processed before acceptance. Review your order carefully—cancellations may not be possible after acceptance. If we don’t accept or must change/cancel, we’ll try to notify you via the contact details provided. Returns/exchanges are governed by our Refund/Return Policy [LINK]. You confirm purchases are for personal/household use (not for resale or export).

4. Prices and Billing

Prices, discounts and promotions may change without notice. The price charged is the price at checkout and in your confirmation. Unless stated otherwise, prices exclude taxes, shipping/handling and import charges. You agree to keep payment details current and warrant you’re authorised to use the chosen payment method.

5. Shipping and Delivery

Delivery times are estimates only. We’re not liable for delays caused by carriers, customs, or events beyond our control. Risk of loss/title passes to you when we hand over goods to the carrier.

6. Intellectual Property

All content on the Services (including trademarks, text, images, graphics, video, audio and their arrangement) is owned by Maya & Zoe Atelier or its licensors and is protected by applicable intellectual property laws. You may use the Services for personal, non-commercial purposes only. No rights are granted except as expressly stated. Our names, logos and marks are our trademarks; Shopify’s marks are owned by Shopify. Do not use any trademarks without prior written consent.

7. Optional Tools

Third-party tools may be provided “as is” and “as available” without warranties. Your use is at your own risk and subject to the third party’s terms. New features or tools are also subject to these Terms.

8. Third-Party Links

The Services may include third-party content or links. We’re not responsible for such sites, their policies, or transactions made there. Review third-party terms before engaging.

9. Relationship with Shopify

Maya & Zoe Atelier is powered by Shopify; however, your purchase is with Maya & Zoe Atelier. Shopify is not responsible for your transactions with us. You expressly release Shopify from claims arising from your purchases with us.

10. Privacy

Personal information is handled per our Privacy Policy [LINK]. Because the Services are hosted by Shopify, certain data is also processed by Shopify per Shopify’s privacy terms. See our Privacy Policy for details.

11. Feedback

By submitting reviews, ideas or suggestions (“Feedback”), you grant us a worldwide, royalty-free, sublicensable, perpetual licence to use and display such Feedback for any purpose. You warrant you have the necessary rights and that your Feedback complies with law and these Terms. We may monitor, edit or remove Feedback at our discretion.

12. Errors, Inaccuracies and Omissions

We may correct errors or update information (including pricing, availability, shipping charges and transit times) at any time without notice, including after an order is submitted.

13. Prohibited Uses

You may use the Services lawfully only. Prohibited conduct includes, without limitation: illegal activity; IP infringement; harassing/abusive behaviour; transmitting malware; misleading or impersonation; scraping; spamming; collecting personal data of others; or attempting to bypass security. We may suspend or terminate access for violations.

14. Termination

We may terminate or suspend access to the Services at any time. You remain liable for amounts due up to termination. Sections intended to survive (e.g., IP, Feedback, Disclaimers, Liability, Indemnity, Severability, Governing Law) survive termination.

15. Disclaimer of Warranties

Except as required by law, the Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for purpose, title and non-infringement. We do not guarantee uninterrupted, timely, secure or error-free service.

16. Limitation of Liability

To the maximum extent permitted by New Zealand law, Maya & Zoe Atelier and our officers, employees, agents, partners, service providers and licensors shall not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, savings, data or replacement costs, arising from your use of the Services or products.

You agree to indemnify and hold harmless Maya & Zoe Atelier (and our affiliates, officers, employees, agents, contractors and service providers) from claims and expenses arising from your breach of these Terms, violation of law or third-party rights, or misuse of the Services.

18. Severability

If any provision is unlawful, void or unenforceable, the remaining provisions remain in full force and effect.

19. Waiver; Entire Agreement

No waiver of any term is a continuing waiver. These Terms, together with posted policies (including our Privacy and Refund/Return Policies), constitute the entire agreement between you and us and supersede prior understandings.

20. Assignment

You may not assign these Terms without our prior written consent. We may assign or transfer these Terms without notice.

21. Governing Law

These Terms and any disputes arising out of or relating to them are governed by the laws of New Zealand. You and Maya & Zoe Atelier submit to the exclusive jurisdiction of the courts of New Zealand (venue: Auckland, unless otherwise required by law). Nothing in these Terms limits your rights under the New Zealand Consumer Guarantees Act 1993 or Fair Trading Act 1986, which may apply and cannot be excluded.

Headings are for convenience only and do not affect interpretation.

23. Changes to Terms

We may update these Terms from time to time. The current version will be posted on this page with an updated date. Material changes will be notified as required by law. Your continued use of the Services after changes indicates acceptance.
